DUI / OVI Laws - The Pater Halverson Difference

I have been practicing exclusively in Butler County for over twenty years, specializing in DUI and criminal defense. There are three types of DUI/OVI defense attorneys. On the one extreme, there is the attorney who wants to quickly get your retainer; plead out the case without doing any work; and move onto the next unsuspecting client. On the other extreme, there are the attorneys who want $3500 or $5000 to take your case all the way thru the appeal when they lose the jury trial. They wow you by saying all the right things and pushing everyone as hard as they can. The problem with these attorneys is that often their client doesn't want the case to go as far as the attorney's ego wants it to. Also, I have actually witnessed police officers who will not agree to reductions for these attorneys because they have been mistreated so badly by them in past cases. The third group of attorneys is the group I fall into. I will watch the video; protect your rights by filing the correct motions on time; review breathalyzer calibration records and give you an honest opinion as to the potential benefits of fighting the case or working out the best result short of trial. This gives you a fair assessment of your case without an unfair hit to your wallet.

When you are pulled over for driving under the influence of alcohol or drugs, the officer may request that you comply with a field sobriety test or use a breathalyzer. You have the right to decline both, though the officer may assume your refusal is an admission of guilt and arrest you. Officers are required to comply with the law regarding any breath, urine or blood samples that they obtain from you. We will make sure your rights are protected and the officer follows the law.

DUI convictions are processed under OVI (Operating a Vehicle Impaired) Laws. Ohio has minimum mandatory sentencing for DUI convictions, including jail, fines and a license suspension. The penalties increase with each additional DUI, up to the fourth, which is a felony.
